The Commodity Futures Trading Commission (CFTC) is probing Polymarket‘s controls and its advertising activity in the United States, Reuters reported on Tuesday, October 27, according to a headline carried by the news wire BWEnews. At the time of writing, neither the CFTC nor Polymarket had published a statement on the report, and details on the scope of the review were not available.
Months of scrutiny over marketing
The report is not the first sign of regulatory interest. In June, CNBC and Politico reported, citing a person familiar with the matter, that the CFTC was conducting an “extensive investigation” into the company. That followed a Wall Street Journal investigation into Polymarket promotional videos in which content creators appeared to win bets that were never placed on the platform.
Polymarket said at the time that it was “conducting a comprehensive audit of active promotional content” to make sure it met its standards and disclosure requirements. US senators Adam Schiff and John Curtis also wrote to CFTC Chairman Michael Selig in late June asking whether the agency was investigating the conduct, and in August the New York City Council opened its own inquiry into alleged predatory marketing by prediction platforms, Reuters reported.
Election markets under the spotlight
The news lands a week before the US midterm elections, when Polymarket’s political markets draw some of their heaviest volume. On the same day, NPR reported that Polymarket has investigated “dozens” of midterm-related bets for possible insider trading or manipulation, with at least two cases referred to the CFTC, according to a person familiar with the probes.
What it means for traders
- Headline risk for prediction markets: regulatory news can move liquidity and odds on platforms like Polymarket, especially around high-profile events such as the midterms.
- No finding yet: a probe is not an enforcement action. No violations have been announced, so treat follow-up headlines carefully and wait for official statements.
- Know where you trade: regulated status, licences and marketing rules differ by platform and country. Our crypto exchange comparison and testing methodology explain what we check. In our tests, BingX ranks first and OKX second; see BingX vs OKX.
